Familial Sex Offences Law and Legal Definition
Familial sex offences refer to a group of criminal offence under the Sexual Offences Act 2003 prohibiting sexual activity with family members. These offences replace the incest offences of previous legislation. In determining the seriousness of familial sex offences the following factors are considered by the court namely, the nature of the sexual activity; age and degree of vulnerability of the victim; the age gap between the victim and the offender; and the breach of trust arising from the family relationship.
