Family Farmer With Regular Annual Income Law and Legal Definition
The term ‘family farmer with regular annual income’ means a family farmer whose annual income is sufficiently stable and regular to enable such family farmer to make payments under a plan under chapter 12 of the bankruptcy code [11 USCS § 101 (19)]. The definition of family farmer with regular annual income is very broad and was designed to allow every person who qualifies as a family farmer to be eligible for relief provided under chapter 12. A family farmer includes individuals, corporations, family owned partnerships, or business entity whose debts and income arise primarily from a family owned and operated farming operation.
