Fatal Injury Law and Legal Definition
Fatal injury means a personal injury resulting in death of the injured person. [Provident Life & Acci. Ins. Co. v. Johnson, 235 S.W. 650 (Tex. Civ. App. 1921)].
The exact definition of the term varies from state to state. It also depends on the context in which it is used. For example, in New Hampshire, the tern ‘fatal injury’ when used in the context of aeronautics means any injury which results in death within 30 days from the date of the injury. [RSA 422:3].
The following is an example of a state statute (Nebraska) defining the term:
According to R.R.S. Neb. § 85-2303, fatal injury means an event occurring in the line of duty which is a proximate cause of the death of a law enforcement officer or firefighter.
