Feigned issue refers to an issue in a suit in equity, presented for trial at law before a jury, under the pretext of a fictitious wager. It is an issue formed in a pretended action between two parties for the purpose of trying before a jury a question of fact which it becomes essential to settle in the progress of a cause.
