A fictitious promise refers to a promise that allows a person to take advantage of the old rules of pleading peculiar to contracts even though it does not possess any current practical importance. Such promises are created by law to make a person liable on a contract so as to avoid fraud or unjust enrichment. Fictitious promise is also known as implied promises or promises implied in law.
