Final Audit Determination [Education] Law and Legal Definition
According to 34 CFR 668.112 (a) [Title 34 – Education; Subtitle B – Regulations of the Offices of the Department of Education; Chapter VI -- Office of Postsecondary Education, Department of Education; Part 668 -- Student Assistance General Provisions; Subpart H -- Appeal Procedures for Audit Determinations and Program Review Determinations], the term final audit determination means “the written notice of a determination issued by a designated department official based on an audit of --
(1) An institution's participation in any or all of the Title IV, HEA programs; or
(2) A third-party servicer's administration of any aspect of an institution's participation in any or all of the Title IV, HEA programs.
(b) Final program review determination means the written notice of a determination issued by a designated department official and resulting from a program compliance review of --
(1) An institution's participation in any or all of the Title IV, HEA programs; or
(2) A third-party servicer's administration of any aspect of an institution's participation in any Title IV, HEA program.”
