Free and Clear Law and Legal Definition
Free and clear is a phrase used to describe the marketable value of a property. A title is free and clear when it is free off liens and legal questions as to ownership of the property. It is the prime requirement for the sale of real estate.
Free and clear title means title that is unencumbered by any liens and is marketable. [Kohlbrand v. Ranieri, 159 Ohio App. 3d 140, 143 (Ohio Ct. App. 2005)].
