Freedom of testation is a right that a person has to determine his/her heir to property upon his/her death. A property owner is allowed to modify the rigid rules of the intestacy laws so as to adapt them to the particular situation of his/her family by preferring. Freedom of testation also implies the freedom of making provision for charity. However, the freedom of testation will be checked if the person is of unsound mind.
