Lascivious Cohabitation Law and Legal Definition
Lascivious cohabitation is a mostly an archaic crime. It is an offense in which two members of the opposite sex live together as husband and wife, and engage in sexual intercourse without first entering into a legal or religious marriage.
This offense still exists in some jurisdictions. For example, Virginia law consider lewd and lascivious cohabitation as a misdemeanor. [Va. Code Ann. § 18.2-345]. However, such crimes are seldom prosecuted. Lewd and lascivious cohabitation is a misdemeanor (though rarely enforced) under Michigan law. [In re Petition of Odeh, 185 F. Supp. 953, 955 (D. Mich. 1960)].
