Licentia Surgendi Law and Legal Definition
Licentia surgendy is a Latin term meaning, license to arise. It also means permission or writ from the court to a tenant in a real action. Under licentia surgendi, a tenant is obliged to appear in court, following the tenant’s earlier plea of inability to appear because of illness that confined the tenant to bed. However, the tenant could lose the case by default for falsely claiming illness.
