Lying by Law and Legal Definition
Lying by refers to the act or fact of being present at a transaction affecting one's interests but remaining silent. A person interested in a transaction to which s/he is not a party may give assent to the transaction by presence or silence. The person so giving assent cannot later disturb the transaction as courts treat such a person who was “lying by” at a transaction as having agreed to it.
