Mandate Rule Law and Legal Definition
Mandate rule is a principle that states an inferior court has to comply with the mandates issued by any appellate court. This mandate rule thus places the inferior courts with an obligation to comply the order of the appellate court and also takes off the inferior courts’ power or authority to deviate from the mandate so issued. However an exception is provided in cases where new evidence or an intervening change in law happens.
