Marital Portion Law and Legal Definition
Marital portion refers to the rightful share or portion of a widow in the estate of her deceased husband. In Louisiana, marital portion is that part of a deceased husband's estate, to which the widow is entitled.
The following is an example of a state law (Louisiana) on marital portion:
La. C.C. Art. 2432. When a spouse dies rich in comparison with the surviving spouse, the surviving spouse is entitled to claim the marital portion from the succession of the deceased spouse.
