Migrant Agricultural Worker Law and Legal Definition
A migrant agricultural worker is “an individual who is employed in agricultural employment of a seasonal or other temporary nature, and who is required to be absent overnight from his permanent place of residence.” (29 USCS § 1802)
The United States enacted the Migrant and Seasonal Agricultural Workers Protection Act in 1983 to remove the restraints on commerce caused by activities injurious to migrant and seasonal agricultural workers, to require farm labor contractors to register with the U.S. Department of Labor, and to assure necessary protections for farmworkers, agricultural associations, and agricultural employers. The Act also assures necessary protections for migrant and seasonal agricultural workers, agricultural associations, and agricultural employers.
