Migrant Farmworker Law and Legal Definition
According to 34 CFR 206.5 (c) (6) [Title 34 – Education; Subtitle B -- Regulations of the Offices of the Department of Education; Chapter II -- Office of Elementary and Secondary Education, Department of Education; Part 206 -- Special Educational Programs for Students Whose Families are Engaged in Migrant and Other Seasonal Farmwork -- High School Equivalency Program and College Assistance Migrant Program; Subpart A – General], the term migrant farmworker means “a seasonal farmworker--as defined in paragraph (c)(7) of this section--whose employment required travel that precluded the farmworker from returning to his or her domicile (permanent place of residence) within the same day.”
