Misrepresentation [Education] Law and Legal Definition
According to 34 CFR 668.71 (b) [Title 34 – Education; Subtitle B -- Regulations of the Offices of the Department of Education; Chapter VI -- Office of Postsecondary Education, Department of Education; Part 668 -- Student Assistance General Provisions; Subpart F – Misrepresentation], the term misrepresentation means “any false, erroneous or misleading statement an eligible institution makes to a student enrolled at the institution, to any prospective student, to the family of an enrolled or prospective student, or to the Secretary. Misrepresentation includes the dissemination of endorsements and testimonials that are given under duress.”
