Misspelled Words as Marks [Trademarks] Law and Legal Definition
Misspelled words can be used as trademarks. Business owners choose misspelled words that are phonetically similar to the correctly spelled word to add distinctiveness. Misspelled terms are used as marks also as a marketing ploy. However, trademark law considers words that are misspelled, but otherwise descriptive of a product to be the same as the non-misspelled descriptive term for that product.
