Misuse of a Product Law and Legal Definition
Pursuant to the Uniform Comparative Fault Act, "Misuse of a product" means a misuse giving rise to a danger that could have been reasonably anticipated and guarded against. However, the Act does not apply to a misuse giving rise to a danger that could not reasonably have been anticipated and guarded against by the manufacturer, so that the product was therefore not defective or unreasonably dangerous.
