Model Marriage and Divorce Act Law and Legal Definition
The Uniform Law Commissioners promulgated the Uniform Marriage and Divorce Act in 1970. It was extensively amended in 1973. This act is a comprehensive marriage and divorce act. It minimizes the number of prohibited marriages, and includes the concept of no-fault divorce. It introduced irreconcilable differences as the sole ground for divorce. UMDA has been partly enacted only in a handful of states. However, it has had an enormous impact on marriage and divorce laws in all states. A state could enact separately the part on marriage and/or separately the part on divorce. This act is now regarded by the NCCUSL as a model act, instead of a uniform act, and so it may be known as the Model Marriage and Divorce Act.
