Morte Donantis Donatio Confirmatur is a Latin maxim which means ‘a donation is confirmed by the death of the donor’. Ordinarily, donations need no confirmation, as it is irrevocable. However, a donation between husband and wife is revocable at any time, during donor’s lifetime. After donor’s death the property becomes the absolute property of the donee. On confirmation by the death of the donor, a donation cannot be challenged by the heirs of the donor.
