Morte Legatarii Perit Legatum Law and Legal Definition
Morte legatarii perit legatum is a Latin maxim which means the legacy perishes or lapses by the death of the legatee. The legatee must die during the lifetime of the grantor of the legacy .Morte legatarii perit legatum applies only when legacy is granted to the legatee individually. Thus when a grantor bequeaths to his/her son and his heirs, the maxim cannot be applied. Normally, when any of the heirs survive, legacy to a class of persons survive, and will not lapse by the death of one of legatee.
