Municipal Action Law and Legal Definition
Municipal action refers to exercise of governmental power by a municipal office. Municipal offices include: municipal board, agency or other body.
Municipal actions are entitled to a presumption of validity and so typically enjoy great deference by a reviewing court. A municipal action will only be overturned upon a showing that the action in question was arbitrary, capricious or unreasonable. [Koopman v. Twp. of Marlboro Planning Bd., 2009 N.J. Super. Unpub. LEXIS 1399 (App. Div. 2009)].
