Pars Ejusdem Negotii Law and Legal Definition
Pars ejusdem negotti means part of same transaction. Some obligations are coupled with conditions. Until the completion of such condition, an obligation undertaken conditionally cannot be fulfilled. A duty coupled with a condition can be enforced only when the condition is satisfied. Performance of the condition is an essential requisite for the enforcement of certain contracts. Generally obligations and conditions are considered pars ejusdem negotii and are considered together as forming part of same transaction. However, a claim for compensation is not pars ejusdem negotti.
