Passive Breach of Contract Law and Legal Definition
Passive breach of contract is a failure to perform the requirements of a contract. Up to 1984, in Louisiana, passive breach of contract was contrasted with active breach of contract. Active breach was negligence in performance of a contractual obligation. Active breach of contract give rise to claims in contract and in tort, while a passive breach of contract generally, does not give rise to a tort claim.
