According to 5 CFR 302.103 [Title 5 -- Administrative Personnel; Chapter I -- Office of Personnel Management; Subchapter B -- Civil Service Regulations Part 302 -- Employment in the Excepted Service; Subpart A -- General Provisions], person entitled to priority consideration means “a person who was furloughed or separated without misconduct, from a position without time limit, because of a compensable injury and whose recovery takes longer than 1 year from the date compensation began.”
