Plea in Confession and Avoidance Law and Legal Definition
A plea in confession and avoidance is a plea which admits the cause of action alleged by the plaintiff, to the extent at least of giving color to the matter, and sets up other matter in avoidance of the same. It is a plea that admits the truth of allegations made in former pleading but presents new information that neutralizes or avoids the legal ramifications of those admitted facts.
