Prenatal Tort Law and Legal Definition
Prenatal tort is a tort involving an unborn child. It is a tort committed against a fetus and if the child is born alive, a suit can arise for injuries resulting from tortuous conduct predating the child’s birth. A prenatal tort can include a personal injury action by a child born alive, wrongful conception/pregnancy, wrongful life, and wrongful birth.
