Privacy Privilege refers to a defendant's right not to disclose private information unless the plaintiff can show that
- The information is directly relevant to the case, and
- The plaintiff's need for the information outweighs the defendant's need for nondisclosure.
In U.S. privacy privilege is recognized only in few jurisdictions. For example, California is one state that has recognized privacy privilege.
