Private Cemetery Law and Legal Definition
A private cemetery is one used only by a family or a small portion of the community. The mode of use rather than ownership determines whether a cemetery is public or private. A public cemetery is one used by the general community, a neighborhood, or a church. There are statutory provisions which apply to privately operated cemeteries. Cemetery Care Act provides that these cemeteries are required to secure a license from the Auditor of Public Accounts before acquiring care funds.
