Prosecution-History Estoppel Law and Legal Definition
In patent law, prosecution-history estoppel is a doctrine that limits a patentee's invocation of the doctrine of equivalents. Such an invocation is limited by eliminating from the claims those elements which the holder had surrendered or abandoned during the prosecution of the patent. Prosecution-history estoppel is also termed as estoppel on the record and file-wrapper estoppel.
