Protective Proceeding (Guardianship) Law and Legal Definition
The term 'protective proceedings' is used to refer to those legal proceedings initiated to appoint a person or professional to protect the person and property of an individual who cannot effectively manage his/her own affairs. The person may not be capable of effective management because the person lacks ability, s/he is an incapacitated person, or because the person is a minor. The protective proceeding is initiated to secure administration of the estate by a conservator or a guardian, or for any other appropriate relief considering the circumstances.
