Provisional Partition Law and Legal Definition
Provisional partition is that which is made provisionally, either of certain things before the rest can be divided, or even of everything that is to be divided, when the parties are not in a situation to make an irrevocable partition. It si also called as a temporary partition. According to the principles of equity heirs who are of age, and parties to a provisional partition, cannot complain about the provisional partition. But minors and co-heirs who are not made parties can prefer a complaint.
