Public-Function Test Law and Legal Definition
Public-function test is a doctrine that is applicable for suits under 42 USCS § 1983. This is a legal principle which states that a private person’s actions constitute state action provided the private person performs functions which are traditionally reserved to the state. A public-function test is also termed as public-function doctrine or a public-function theory.
