Public Highway-Rail Grade Crossing Law and Legal Definition
According to 49 CFR 222.9 [Title 49 – Transportation; Subtitle B -- Other Regulations Relating to Transportation; Chapter II -- Federal Railroad Administration, Department of Transportation; Part 222 -- Use of Locomotive Horns at Public Highway-Rail Grade Crossings; Subpart A – General], public highway-rail grade crossing means, “a location where a public highway, road, or street, including associated sidewalks or pathways, crosses one or more railroad tracks at grade. If a public authority maintains the roadway on both sides of the crossing, the crossing is considered a public crossing for purposes of this part.”
