Qualifying Volume Law and Legal Definition
According to 10 CFR 490.702 [Title 10 Energy; Chapter II Department of Energy; Subchapter D Energy Conservation; Part 490 Alternative Fuel Transportation Program; Subpart H Biodiesel Fuel Use Credit], the term qualifying volume means --
“(1) 450 gallons; or
(2) If DOE determines by rule that the average annual alternative fuel use in light duty vehicles by fleets and covered persons exceeds 450 gallons or gallon equivalents, the amount of such average annual alternative fuel use.”
