Que estate literally signify quem statum, or which estate. At common law, it is a plea by which a man prescribes in himself and those whose estate s/he holds.
It is a claim to have acquired by prescription an easement by virtue of the continuous use of the right both by the claimant and by those whose estate s/he has.
