Sale Warranties Law and Legal Definition
Sale warranties refers to sale of consumer goods that are sold at retail which will be accompanied by the manufacturer's and the retail seller's implied warranty that the goods are merchantable. The retail seller will have a right of indemnity against the manufacturer in the amount of any liability.
The following is an example of the state statute (California) stating the obligations of distributors or sellers of used goods under sale warranty:Cal Civ Code § 1795.5 states that the obligation of the distributor or retail seller who makes express warranties with respect to used goods that are sold in this state, shall extend to the sale of all such used goods, regardless of when such goods may have been manufactured.
