Seasonal Farmworker Law and Legal Definition
According to 34 CFR 206.5 (c) (7) [Title 34 – Education; Subtitle B -- Regulations of the Offices of the Department of Education; Chapter II -- Office of Elementary and Secondary Education, Department of Education; Part 206 -- Special Educational Programs for Students Whose Families are Engaged in Migrant and Other Seasonal Farmwork -- High School Equivalency Program and College Assistance Migrant Program; Subpart A – General], the term seasonal farmworker means “a person who, within the past 24 months, was employed for at least 75 days in farmwork, and whose primary employment was in farmwork on a temporary or seasonal basis (that is, not a constant year-round activity).”
