Service of process publication means the service of summons or other process upon a defendant who is absent or non resident within the jurisdiction of the court issuing the summons. Service of process publication is made either by fixing a notice in the court house door or by publishing the same as an advertisement in a designated newspaper having general circulation. A service of process publication is allowed only by leave of the court. It is generally granted in situations where a plaintiff can show that no other method of service can be effected.
Service of process publication requires publication of legal notice in at least one newspaper of general circulation where the defendant is likely to be found or where the court is located or in both places. Generally, the notice must be published once a week for three weeks. This form of service is deemed complete and effective.
