Solid Waste Law and Legal Definition
“Solid waste is broadly defined as any discarded material, including secondary materials when they are recycled.” Howmet Corp. v. United States EPA, 2009 U.S. Dist. LEXIS 87175 (D.D.C. Sept. 23, 2009)
According to 36 CFR 6.3 [Title 36 Parks, Forests, and Public Property; Chapter I National Park Service, Department of the Interior; Part 6 Solid Waste Disposal Sites in Units of the National Park System.] Solid waste means “garbage, refuse, sludge from a waste treatment plant, water supply treatment plant, or air pollution control facility and other discarded material, including solid, liquid, semisolid, and contained gaseous material resulting from industrial, commercial, mining and agricultural operations or from community activities. "Solid waste" does not include a material listed under 40 CFR 261.4(a).”
