Standard Patent Application Law and Legal Definition
A standard patent application is a patent application meeting all the requirements for the grant of a patent. It contains all necessary parts that must be present in a patent application. For example, a standard patent application includes details such as a written description of the invention and claims patented for. It is not mandatory that a standard patent application be allowed. The application may or may not result in the grant of a patent depending upon the outcome of an examination by the patent office in which it is filed.
In the U.S., a standard patent application is referred to as a ‘nonprovisional’ application. An examination process is initiated by filing the nonprovisional application. A nonprovisional application establishes the filing date. A nonprovisional utility patent application must include specifications, claims, and drawings, and a filing fee.
