Statement of Claim against Estate Law and Legal Definition
The Statement of Claim against Estate is a written claim or statement filed upon the death of a person and beginning of probate by a person who believes that s/he is entitled to receive money by the deceased. The Statement of Claim against Estate is filed by a person to whom the estate owes money. Here a claimant can file the claim with the court where the deceased was a resident. Under this Statement details such as name of the deceased, deceased’s estate number, the amount owed by the estate, and nature of the claim are to be mentioned. In cases where the Claimant has some type of security for his/her claim, then s/he must specify what type of security held. The Claimant must also swear to the accuracy of the contents of the Statement as the Affiant.
