Statement of Use Law and Legal Definition
A Statement of use (SOU) is an oath filed by an applicant or the applicant's attorney. The applicant makes allegation of use in the SOU that the applicant is actually using the trademark in interstate commerce in connection with the goods and services originally filed for. If the trademark application was filed on a use basis, then there is no need to file a SOU. However, if the application was filed on intent to use basis, and after the applicant received a notice of allowance, the applicant should file the SOU within six months from the issue date of the notice of allowance. If the applicant does not file a SOU, the application will be abandoned.
