Substitute facilities doctrine is a concept whose origins are from the dicta in Brown v. United States, 263 U. S. 78. The Brown court found that in condemnation cases, it would have been constitutionally permissible for the federal government to provide the city with a substitute landfill site instead of compensating it in cash.
