Subtenancy Law and Legal Definition
Subtenancy is the act of leasing a property by a lessee. The period of sublease will be shorter than the primary lease. The sublease process and formalities are the same as actual lease. Certain lease agreements will contain a clause stating that the lessee may sublet the property only with the specific consent of the landlord. A sublease comes to an end upon forfeiture of the actual lease. A subtenant is a person who has the right to use and occupy rental property leased by a tenant. A subtenant is responsible to both the landlord and the tenant.
