Superfund Memorandum of Agreement Law and Legal Definition
Superfund Memorandum of Agreement (SMOA) is a nonbinding, written document executed by the Environmental Protection Agency Regional Administrator and the head of a state agency. [40 CFR 300.5]. For example, a SMOA may be entered between the Environmental Protection Agency (EPA) and the head of the State Department of Health. The SMOA establishes the nature and extent of EPA and state interaction during the removal, pre-remedial, remedial, and enforcement response process in matters of environmental concern. Ordinarily, the SMOA defines the role and responsibilities of both the lead and the support agencies.
