According to 8 CFR 204.301 (Title 8 -Aliens And Nationality; Chapter I - Department Of Homeland Security (Immigration And Naturalization);Subchapter B - Immigration Regulations; Part 204 - Immigrant Petitions; Subpart C - Intercountry Adoption Of A Convention Adoptee), a surviving parent means “the child's living parent when the child's other parent is dead, and the child has not acquired another parent within the meaning of section 101(b)(2) of the Act and this section.”
