Systematic Violation Law and Legal Definition
Systematic violation refers to an employer’s policy or procedure that is discriminatory against an employee. It is a policy or procedure that is usually considered a continuing violation. Systematic violation is an employee’s claim of unlawful discrimination that will not be barred as untimely as long as some discriminatory effect of policy or procedure occurs within the limitation period.
In Mansourian v. Regents of the Univ. of Cal., 2010 U.S. App. LEXIS 8487 (9th Cir. Cal. Apr. 20, 2010), it was held that a university's ongoing and intentional failure to provide equal athletic opportunities for women is a systemic violation.
