According to 41 CFR 60-3.16 (Title 41 - Public Contracts And Property Management; Subtitle B - Other Provisions Relating To Public Contracts; Chapter 60 - Office Of Federal Contract Compliance Programs, Equal Employment Opportunity, Department Of Labor; Part 60-3 - Uniform Guidelines On Employee Selection Procedures (1978) (Definitions), unfairness of selection procedure means a condition in which members of one race, sex, or ethnic group characteristically obtain lower scores on a selection procedure than members of another group, and the differences are not reflected in differences in measures of job performance.” (41 CFR 60-3.16)
