Vallescura Rule Law and Legal Definition
The term Vallescura Rule signifies the rule formulated by the United States Supreme Court in the case, Schnell v. The Vallescura in 1934. The rule states that when cargo is lost or damaged for more than one reason, one of which the carrier is responsible for and the other for which the carrier is not responsible, the carrier must establish what portion of the loss or damage s/he is responsible for and if s/he fails to demonstrate his/her portion of liability, then the carrier may be responsible for all of the damage.
